Why NBI must be an independent agency

I rise to seek leave of the House to introduce a private member’s bill to amend the National Bureau of Investigation Act 1973 to establish the NBO as a fully independent agency answerable only to Parliament to free it from political or Ministerial  influence and interference so that it could effectively combat corruption, especially corruption in high political places.

When the NBI was first established it was put directly under the Prime Minister’s Office, presumably to convey t the people the impression that the NBI’s work will have the support of the Prime Minister himself. But from the Prime Minister’s Office the NBI was transferred t the Attorney-General’s Department, which marked a downgrading in importance of the NBI in government circles. On a clean, honest and incorrupt government

(Speech by the Parliamentary Leader, DAP Secretary-General and Member of Parliament for Kota Melaka, Lim Kit Siang, in the Dewan Rakyat when moving a motion to introduce a private member’s bill to be known as Ministers and Members of Parliament (Declaration of Assets) Act 1978 on October 18, 1977)

I rise under Standing Orders 49 to move a motion to seek leave of the House to introduce a private member’s bill to be known as Ministers and Members of Parliament (Declaration of Assets) 1978 Bill requiring every Minister and Member of Parliament to publicly declare his or her assets annually and that of the next of kin.

The Prime Minister, Datuk Hussein Onn, has a personal reputation of being opposed to corrupt practices, the country has a National Bureau of Investigations, and every now and then we read of departmental heads requiring their public servants to declare their assets. But it cannot be denied that corruption in Malaysia is a rampant problem, with many top political and public servants possessing unaccounted wealth and property. Corruption has become rifer with the passing years. The NBI has proved to be an ineffective instrument to fight corruption at all levels of government, and from all sectors of public life.

I expect the Prime Minister, Dato Hussein Onn, to call for a general elections next March or April. Even the most optimistic Barisan Nasional political and election strategists do not believe that they could hold their 1974 parliamentary and State Assembly seats. The transfer of the National Bureau of Investigations from the Prime Minister’s Department early this year to the Ministry of Law and A.G.’s Department was seen as a downgrading of the NBI.
