Yesterday, during the debate on the last bill, the Dangerous Drugs (Special Preventive Measures) Amendment Bill 1985, the Speaker, Tan Sri Zahir Ismail, interjected during my speech to remark that Parliamentary is akin to the highest court in the land. I agree, and this is why it is importance for the public confidence and public respect in the system of Parliamentary democracy that Parliamentary proceedings should not only be fair, but seen to be fair. The Dangerous Drugs (Special preventive Measures) Amendment Bill 1985 is to legalise illegal detention orders and offends against the fundamental rule of law against retrospective legislation.

The Government has introduce another bill, to be taken through all its stages, in this parliamentary meeting which ends on Friday. I find the Dangerous Drugs (Special Preventive Measures) Amendment Bill 1985 most shocking, for clearly it is designed to legalise the illegal detention orders made by the Minister and Deputy Minister of Home Affairs purportedly under the principal Act. DAP to challenge in court the legality of the government’s interpretation of the Dangerous Drug (Special Preventive Measures) Act 1985 that the Minister had no authority to overrule Advisory Board’s decision on extension of detention.

The Deputy Home Affairs Minister, Radzi Sheikh Ahmad, said yesterday that the Home Affairs Minister has no authority to overrule the Advisory Board’s decision to continue detaining 12 men at the Muar rehabilitation centre, which shows that the Home Affairs Minister and the government had misconstructed the provisions of the Dangerous Drugs (Special Preventive Measures) Act 1985.
